1.Services
WarnaCetak provides professional design, printing, and digital solutions, including but not limited to graphic design, branding, web design, and printing of marketing materials, apparel, and promotional items.
The Company reserves the right to modify, enhance, or discontinue any service at its sole discretion.
2.Client Responsibilities
The Client shall provide accurate, complete, and lawful information when placing an order.
The Client warrants that any materials, artwork, or designs submitted for processing do not infringe any intellectual property rights, contain unlawful content, or violate applicable laws.
The Client agrees to indemnify and hold harmless WarnaCetak / Hery Intelligent Technology from any claims, damages, or legal actions arising from the Client’s submitted materials.
3.Orders & Payment
Orders are deemed confirmed only upon receipt of full payment unless otherwise agreed in writing.
All prices are in Malaysian Ringgit (MYR). Prices are subject to change without prior notice.
Payments must be made using Company-approved methods. Late payments may result in delays or cancellation of services.
4.Artwork, Design & Printing
The Client bears full responsibility for verifying the accuracy, quality, and completeness of any artwork submitted.
The Company is not liable for errors in Client-provided files, including typographical errors, low-resolution images, or incorrect formatting
By submitting artwork, the Client grants the Company a non-exclusive, limited license to use the materials strictly for the purpose of fulfilling the order.
5.Production & Delivery
Production timelines vary depending on product type and will be communicated to the Client.
While the Company strives to deliver on time, it shall not be held liable for delays caused by third-party courier services, force majeure events, or circumstances beyond its reasonable control.
Delivery charges, if applicable, will be disclosed before order confirmation.
6.Refunds, Cancellations & Returns
Once production has commenced, orders cannot be canceled.
Refunds are only issued in cases where errors are attributable to the Company.
No refunds or reprints will be provided for errors resulting from Client-submitted materials.
7.Intellectual Property Rights
All content, designs, logos, text, graphics, and materials displayed on www.warnacetak.com are the exclusive property of Hery Intelligent Technology (IP0549884-A) and its sub-brand WarnaCetak.
The Client retains ownership of any submitted designs but grants the Company the right to use such materials solely for production and service purposes.
In addition, certain visual or multimedia content (including images and videos) used in customer projects or on Company platforms may be sourced from Pexels.com under its free license. Such assets remain the intellectual property of their respective creators. Where required, proper credit will be given to Pexels and the original content creator.
Any unauthorized reproduction, distribution, or use of the Company’s intellectual property, or licensed third-party assets, is strictly prohibited.
8.Privacy & Data Protection
The Company collects, processes, and stores personal data in accordance with the Personal Data Protection Act (PDPA) 2010 Malaysia.
Client data shall be used only for order processing, communication, and lawful business purposes.
The Company shall not disclose Client data to third parties except where required for service fulfillment or by law.
9.Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising out of the use of its services.
The Company’s total liability for any claim related to services provided shall not exceed the total fees paid by the Client for the specific order giving rise to the claim.
10.Indemnification
The Client agrees to indemnify, defend, and hold harmless WarnaCetak / Hery Intelligent Technology (IP0549884-A), its officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses resulting from:
The Client’s breach of this Agreement;
The Client’s violation of applicable laws; or
Materials or content provided by the Client.
11.Governing Law & Jurisdiction
This Agreement shall be governed by and construed under the laws of Malaysia. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Johor, Malaysia.
12.Amendments
The Company reserves the right to amend, modify, or update these Terms & Conditions at its sole discretion. Continued use of services constitutes acceptance of such amendments.
